PUBLIC NOTICE: FINDING OF NO SIGNIFICANT IMPACT (FONSI) & INTENT TO REQUEST RELEASE OF FUNDS

Overview

These notices satisfy two separate but related procedural requirements for activities to be undertaken by the Pawnee Nation of Oklahoma.

1. Request for Release of Funds (RROF)

On or about August 2026, the Pawnee Nation of Oklahoma will submit a request to the U.S. Department of Housing and Urban Development (HUD) (Oklahoma City Field Office, Region VI, Southern Plains Office of Native American Programs) for the release of Indian Community Development Block Grant (ICDBG) funds under Title I of the Housing and Community Development Act of 1974, as amended.

  • Project Title: 2025-0122610 — Pawnee Nation Wastewater Enhancement Project
  • Project Purpose: Expanding the Nation’s existing lagoon system and constructing/installing a new water softening system.
  • Project Location: Existing wastewater lagoon infrastructure and adjacent undeveloped land within Pawnee Nation Tribal lands (Coordinates: 36.34152° N, 96.78677° W, Pawnee, OK 74058).
  • Project Funding: Total $1,702,084.00 ($1,349,084.00 from ICDBG/HUD + $353,000.00 from the Pawnee Nation).

2. Finding of No Significant Impact (FONSI)

The Pawnee Nation of Oklahoma has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act (NEPA) of 1969 is not required.

Additional project information is contained in the Environmental Review Record (ERR) on file at the Pawnee Nation Division of Planning & Tribal Development Office (881 Little Dee Drive, Pawnee, OK 74058), which may be examined or copied weekdays between 8:00 A.M. and 5:00 P.M.

Public Comments

Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the Pawnee Nation Executive Director’s Office.

  • Deadline: All comments received on or before Friday, August 7, 2026 (16 calendar days from notice date) will be considered prior to submitting the request for release of funds.
  • Note: Comments should specify which Notice they are addressing.

Release of Funds & Objections

The Executive Director of the Pawnee Nation certifies to HUD that Misty Nuttle, in her capacity as President of the Pawnee Business Council, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process.

HUD will consider objections to its release of funds and the Pawnee Nation’s certification for a period of 15 days following the anticipated submission date or its actual receipt of the request (whichever is later) only if it meets specific regulatory grounds under 24 CFR Part 58.
